    - Cross Street Photography retains the copyright to all images and reserves the right to use any images or custom created artwork for display, publication, studio materials, or other promotional purposes.

    - The Client will be given access to the digital images for the Client's personal use only. The images will be available for viewing and purchasing prints from a private online gallery. The Client may share the images on their website or social media sites with proper credit given to Cross Street Photography.

    - A deposit is required. The deposit fee is in the amount of 25% of the total (rounded up to the nearest dollar). In the event of cancellation or breach of contract by Client, the retainer is non-refundable. No date is reserved until a retainer is received. The retainer shall be applied towards the total cost of the services to be rendered. The total balance of the complete package price must be paid no later than 7 days before the event. If final payment is not received, Photographer is relieved of any contractual duty to perform at said event. Client is responsible for any and all location fees and permits.

    - The parties agree to amicably cooperate to achieve the best possible result for this project. However, due to the limited and subjective nature of the event, Photographer cannot be held responsible if requested photographs are not taken or are missed. Photographer is not responsible for any lack of coverage due to weather conditions, scheduling complications due to lateness of individuals besides Photographer, or any restrictions imposed by the event’s location. Client agrees that any requests submitted to Photographer will be used for organizational purposes only, and in no way contractually bind the Photographer to perform based on those requests. Photographer will make every effort to fulfill all Client requests, but Client acknowledges that Photographer cannot guarantee that all requested images will be delivered.

    - Many of your guests will wish to photograph the event. However, for Photographer’s performance at the event to be at its peak, wedding guests or other individuals must not interrupt Photographer with cameras at the event. Client agrees to give Photographer precedence over the wedding guests to take the photographs for the wedding event described herein. Photographer cannot be held liable for any missed photo opportunities at the wedding if guests taking their own photos at the event interrupt Photographer.

    - Registrars, clergy, and/or venue management may impose restrictions on Photographer’s practices (e.g., prohibiting flash photography or prohibiting photography from certain locations altogether). Under such conditions, Client agrees to accept these limitations on Photographer’s performance.

    - If Cross Street Photography cannot perform this Agreement due to a casualty, act of God, or other cause beyond the control of the parties, or due to the Photographer's illness, then Cross Street Photography shall return the amount paid by the Client, but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Cross Street Photography.

    Additional Terms and Conditions

    1. This Agreement sets forth the entire agreement between Client and Photographer and supersedes any prior Agreements or understandings, oral or written with respect to the subject matter hereof.

    2. Photographer is not responsible for any damage to garments arising from environmental conditions or events. Client is responsible for arranging personal assistance for garments.

    3. The waiver of one provision of this Agreement does not waive any other provision. The party against whom a waiver is sought to be enforced must have signed a waiver in writing.

    4. Photographer is not Client’s agent or representative and has no authority to bind or commit Client to any agreements or other obligations.

    5. Each party’s remedy, if any, for any breach of this Agreement by the other party shall be solely in monetary damages and the injured party shall look solely to breaching party for recovery of such damages. Both parties waive and relinquish any right either might otherwise have (a) to obtain injunctive or equitable relief for any reason, and (b) to proceed against any third party with respect to any dispute arising under this Agreement.

    6. This Agreement shall be governed by and construed under the laws of the State of Maine applicable to agreements made and fully performed therein. The state courts of the State of Maine in Waldo and, if the jurisdictional prerequisites exist at the time, the United States District Court, shall have sole and exclusive jurisdiction to hear and determine any dispute or controversy arising under or concerning this Agreement.
